GENERAL CONDITIONS OF USE

1. THESE GENERAL CONDITIONS AND THEIR ACCEPTANCE

These general conditions (the “General Conditions”) govern the use of contents and services on the www.bumeran.com Web site (the “Site”) that BUMERAN.COM ARGENTINA, S.A. (“BUMERAN”) offers Internet users.

Using the site attributes the condition of Site users (the “User”) and indicates the user’s full acceptance of all these general conditions as published by BUMERAN at the moment the User accesses the Site. Therefore, the User should read carefully the General Conditions every time he uses the Site.

The use of certain services offered to the Users through the Site, is subject to its own particular conditions that, according to each case, replace, complete and/or modify the General Conditions (the “Particular Conditions”). Therefore, before using these services, the user should also read carefully the corresponding Particular Conditions.

Likewise, the use of the Service is subject to every notice, use and instruction regulations BUMERAN informs the User, that complete what is foreseen in these General Conditions as long as it is not against them.

2.OBJECTIVE

BUMERAN makes access and use of several services and contents related to job searching easier for users through the Site, placing job openings provided by a third party (company) that wants to start a candidate selection process, managing a resume database of job seekers who voluntary provide personal information to be included in it, and publishing contents about matters linked to the labor world that BUMERAN, or third parties that are Site Users and/or third parties that supply services and contents, offer Users, as well as any other product, service or content accessible through the Site (the “Services”).

BUMERAN reserves the right to unilaterally modify, at any time and without prior warning, the presentation and configuration of the Site, as well as the Services, these General Conditions and/or the particular conditions required to use the Site and the Services.

3. CONDITIONS TO ACCESS AND USE THE SITE

3.1 Access and use of the Site

BUMERAN does not demand prior User subscription or registration to access and use the Site. However, you can only use some of the Services offered on the Site by means of User subscription or registration and/or paying a price, in the way specifically indicated in the corresponding Particular Conditions.

3.2 User Registration

BUMERAN keeps some of the Services offered on the Site for those who become BUMERAN registered users through the act of completing the BUMERAN User register at the disposal of those users that wish to sign up at http://www.bumeran.com.ar/empresas/e_datosempresa_1.ngmf.

However, BUMERAN offers Users certain services that require completing additional registers to be able to use them.

In both cases, you are responsible for choosing, using and keeping your user name (the “User Name”) and password (the “Password”) (from now on and as a whole the “Access Codes”) as established by clauses 3.2.1 and 3.2.2 of these General Conditions.

3.2.1 Access Codes assignment

Users will choose and indicate their own Access Codes. Users won’t be able to choose as User Name words, expressions or graphic sets that are rude, insulting, coincide with brands, trade names, establishment logos, company names, advertising expressions, names and pseudonymous of public or famous people without authorization and, in general, against the law or morals and generally accepted good manners.

The assignment of Access Codes is automatic and the only criterion used for this purpose is the non-existence of previous Access Codes identical to the ones chosen by the Users.

If Users fail to choose Access Codes, these will be automatically assigned by BUMERAN. In this case, Users will be able to change them at any time by one of their choice, always in accordance with the foreseen in the previous paragraph.

3.2.2 Use and Custody

Users agree to use Access Codes in a conscientious way, as well as not share their password or account access information with any other party.

Users agree to immediate notify BUMERAN of any loss or theft of the Access Codes as well as any risk of unauthorized third party access.

3.3 Acceptable Use of the Site and Services.

Users agree to use the Site and Services only for lawful purpose within the stated context of these General Conditions, the applicable Particular Conditions, as well as the morals and generally accepted good manners and public order.

Users may not use the Site and Services for illicit purposes, or in any manner that is against the established in these General Conditions, that will harm the rights and interests of others or that could in any way damage, render useless, saturate or deteriorate the Site and Services or hinder the normal use and enjoyment of the Site and Services by other Users.

3.4 Means to get Contents

Users may not get or even try to get information, resumes, messages, graphics, drawings, sound and/or image files, pictures, recordings, software and, in general, any other type of material that appears on the Site and Services (the “Contents”) using procedures different to the ones available to this effect or that have been indicated to this effect according to each case on the Web pages where you can find the Contents or, in general, those usually used on the Internet to this effect as long as they do not entail the risk of damaging or rendering the Site, Services and/or Contents useless.

3.5 Correct use of the Contents

Users agree to use the Contents in a conscientious, correct, lawful way and are specially prohibited from (a) using the Contents in violation of any applicable law, or for any purpose that goes against morals, generally accepted good manners and public order; (b) reproduce or copy, distribute, allow public access through any type of communication, alter or modify the Contents, unless proper authorization from the holder of the intellectual property rights has been granted or if it proves to be lawfully allowed; (c) eliminate, avoid or manipulate the copyright and other identifying information of BUMERAN rights or its licensors, as well as safety devices, service marks or any other information device that appears in the Contents.

3.6 Introduction of hyperlinks that allow access to the Site Web pages and the Services

Users and, in general, all those people who plan to establish a hyperlink between their Web page and the Site (the “Hyperlink”) should comply with the following conditions: (a) the Hyperlink will only allow access to the Site Web pages, but won’t be able to reproduce them in any way; (b) there will be no hyperlinks to those Site Web pages different from the home page of the Site or Services; (c) no browse or border environment on the Site Web pages shall be created; (d) The Hyperlink won’t include false or misleading information about the Site Web pages and the Services and, in particular, it won’t be declared or implied that BUMERAN has authorized the Hyperlink or supervised or endorsed in any way the contents or services offered to the Web page where the Hyperlink appears; (e) except for those signs that are part of the Hyperlink, the Web page where the Hyperlink appears won’t have any brand, trade mark, establishment label, name, logo, slogan or distinctive marks that belong to BUMERAN; (f) the Web page where the Hyperlink appears won’t include illicit information or contents, that go against morals, generally accepted good manners and public order, as well as contents that violate the privacy or rights of others.

The establishment of the Hyperlink does not entail the existence of any type of relationship between BUMERAN and the owner of the Web page, nor the endorsement by BUMERAN of the contents and services on such third party web site.

4. REGISTRATION INFORMATION

To use some of the Services for which BUMERAN requires completing the registration process, apart from the Access Codes, BUMERAN may request Users to provide personal information (the “Personal Information”) included in the registration forms. Information Users submit will be used in accordance with BUMERAN’S Privacy policy.

5. USE OF COOKIES

We use cookies when Users are visiting the Site. A cookie is a text file that is placed on your hard drive by a Web page server. Our cookies only associated with an anonymous User and his PC and does not include any reference to User name and username. BUMERAN cookies can not read information from your hard drive or cookie files created by another server.  BUMERAN encodes User identifying information as a safety precaution. Cookies enable us to recognize registered Users after they have registered fpr the first time, so that they don’t have to sign up every time they visit the Site in order to access those areas and services meant for them.

Users may have the ability to modify their browser setting to notify them each time a cookie is tendered and permit them to access or decline cookies on an individual basis or modify their browser setting to decline all cookies. Please, read your browser manual for more information. It is not necessary to accept BUMERAN cookies to use the Site. However, if Users choose to decline cookies, that may hinder performance and negatively impact their experience on BUMERAN.

6. USE OF SITE, SERVICES AND CONTENTS UNDER USER RESPONSIBILITY

Users are solely responsible for their use of the Site and Services.

7. WARRANTY AND REPONSIBILITY DISCLAIMER

7.1 Warranty and responsibility disclaimer for Site and Services operation.

7.1.1 Availability and continuity, usefulness and fallibility

BUMERAN makes no guarantees regarding the availability and continuity of Site and Services operation. Not all Services and Contents are generally available for all geographic areas. When reasonably possible, BUMERAN will warn Users of interruptions in Site or Services operation. BUMERAN  does not warrant Site and Services usefulness to carry out any special activity, nor its infallibility and, in particular, although not exclusively, that Users may use the Site and Services, access the different Web pages that make up the Site or those from where services are rendered.

BUMERAN IS NOT RESPONSIBLE FOR DAMAGES OF ANY NATURE THAT COULD BE DUE TO LACK OF AVAILABILITY OR CONTINUITY OF SITE AND SERVICES OPERATION, TO SITE AND SERVICES LACK OF FITNESS FOR THE PARTICULAR USE USERS COULD HAVE GIVEN THE SITE, TO SITE AND SERVICES FALLIBILITY AND, IN PARTICULAR, ALTHOUGH NOT EXCLUSIVELY, TO FAILURES IN THE ACCESS TO THE DIFFERENT WEB PAGES THAT MAKE UP THE SITE OR THOSE FROM WHERE SERVICES ARE RENDERED.

7.1.2 Privacy and security when using the Site and Services

BUMERAN makes no guarantees regarding privacy and security when using the Site and Services and, in particular, it does not warrant that unauthorized third parties may gain access to the type, conditions, characteristics and circumstances of use that Users make of the Site and Services.

BUMERAN IS NOT RESPONSIBLE FOR DAMAGES OF ANY NATURE THAT COULD BE DUE TO UNAUTHORIZED THIRD PARTIES ACCESS TO THE TYPE, CONDITIONS, CHARACTERISTICS AND CISRCUMSTANCES OF USE THAT USERS MAKE OF THE SITE AND SERVICES.

7.2 CONTENT WARRANTY AND RESPONSIBLE DISCLAIMER

7.2.1 Quality

BUMERAN does not control or guarantee that the Contents are free from viruses or any other elements that may produce alterations in your software and hardware or in the electronic files or folders saved in your computer system.

BUMERAN IS NOT RESPONSIBLE FOR DAMAGES OF ANY NATURE THAT COULD BE DUE TO THE PRESENCE OF VIRUSES OR ANY OTHER ELEMENTS IN THE CONTENTS THAT MAY PRODUCE ALTERATIONS IN USERS SOFTWARE, HARDWARE, ELECTRONIC FILES AND FOLDERS.

7.2.2 Lawfulness, reliability and usefulness

BUMERAN makes no guarantees regarding the content of the Site, its lawfulness, reliability and usefulness

BUMERAN IS NOR RESPONSIBLE FOR DAMAGES OF ANY NATURE THAT COULD BE DUE TO THE TRANSMISSION, DIFUSION, SAVING, AVAILABILITY, RECEIPT OR ACCESS TO THE CONTENTS, AND IN PARTICULAR, ALTHOUGH NOT EXCLUSIVELY, FOR DAMAGES THAT COULD BE DUR TO (A) FAILURE TO  COMPLY WITH THE LAW, MORALS, GENERALLY ACCEPTED GOOD MANNERS AND PUBLIC ORDER AS A RESULT OF THE TRANSMISSION, DIFFUSION, SAVING, AVAILABILITY, RECEIPT OR ACCESS TO THE CONTENTS; (B) THE INFRINGEMENT OF INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS, BUSINESS SECRETS, CONTRACTUAL COMMITMENTS OF ANY KIND, HONOR, PERSONAL AND FAMILY PRIVACY AND PERSONAL IMAGE RIGHTS, PROPERTY RIGHTS AND THIRD PARTY RIGHTS OF ANY NATURE AS A RESULT OF THE TRANSMISSION, DIFFUSION, SAVING, AVAILABILITY, RECEIPT OR ACCESS TO THE CONTENTS; (C) THE PERFORMANCE OF UNFAIR COMPETITION AND ILLICIT ADVERTISING ACTS AS A RESULT OF THE   TRANSMISSION, DIFFUSION, SAVING, AVAILABILITY, RECEIPT OR ACCESS TO THE CONTENTS; (D) LACK OF TRUTHFULNESS, ACCURACY, THOROUGHNESS, RELEVANCE AND/OR UPDATING OF THE CONTENTS; (E) THE CONTENTS’  INADEQUACY FOR ANY KIND OF PURPOSE AND THEIR FAILURE TO FULFIL THE CREATED EXPECTATIONS; (F) FAILURE TO COMPLY, DELAY IN THE PERFORMANCE, FAULTY PERFORMANCE OR TERMINATION BY ANY CAUSE OF OBLIGATIONS CONTRACTED BY THIRD PARTIES AND CONTRACTS SIGNED WITH THIRD PARTIES THROUGH OR BECAUSE OF THE ACCESS TO THE CONTENTS; (G) FLAWS OF EVERY KIND OF CONTENTS TRANSMITTED, DIFFUSED, SAVED, MADE AVAILABLE, RECEIVED OR OBTAINED IN ANY OTHER WAY OR THOSE CONTENTS ACCESSED THROUGH THE SITE AND SERVICES.

BUMERAN does not guarantee the truthfulness, accuracy, thoroughness and updating of the Contents and, in particular, of information posted by Users, both users who are job seekers and users who are employers.

BUMERAN IS NOT RESPONSIBLE FOR DAMAGES OF ANY NATURE THAT COULD BE DUE TO LACK OF Truthfulness, accuracy, thoroughness and/OR updating of the Contents and, in particular, of information posted by Users.

7.3 Warranty and responsibility disclaimer for Services rendered by third parties through the Site

7.3.1 Quality

BUMERAN does not control or guarantee that the Services rendered by third parties through the Site are free from viruses or any other elements that may produce alterations in your software and hardware or in the electronic files or folders saved in your computer system.

7.4 Warranty and responsibility disclaimer for information, contents and services located outside the Site.

The Site offers Users linking technical devices (such as links, banners and button icons among others), directories and search tools that allow Users to access Web Sites owned and/or managed by third parties (the “Linked Sites”). The installation of these links, directories and search tools on the Site is meant to make searching and accessing information, contents and services available on the Internet easier for Users.

BUMERAN does not offer or commercialize by itself or through a third party the information, contents and services available on the Linked Sites, it does not monitor them in advance, endorse them, watch them or make them its own. Therefore, Users should be extremely careful when assessing and using  information, contents and services that appear on Linked Sites.

Bumeran does not guarantee or assume responsibility for damages of any nature that could be due to (a) the operation, availability, accessibility and continuity of the linked sites; (b) the upkeep of information, contents and services that appear on the linked sites; (c) the provision or transmission of  information, contents and services that appear on the linked sites; (d) the quality, lawfulness, reliability and usefulness of information, contents and services that appear on the linked sites; according to the same terms and with the same scope as general conditions 7.2 and 7.3 regarding contents and services rendered by third parties through the site.

7.5 Warranty and responsibility disclaimer for use of the Site, Services and Contents by Users

BUMERAN is under no obligation to and does not monitor the use Users make of the Site, Services and Contents. In particular, BUMERAN does not guarantee that Users use the Site, Services and Contents in accordance with these General Conditions and, if that’s the case, the Particular Conditions that shall apply, or that they do it in a conscientious, sensible way. BUMERAN is under no obligation to and does not check the identity of Users, or the truthfulness, validity, thoroughness  and/or authenticity of User data informed to other Users and/or in the Registration Forms.

Bumeran is not responsible  for damages of any nature that could be due to the use of services and contents by users or that could be due to lack of truthfulness, validity, thoroughness  and/or authenticity of the information Users give about themselves to other Users or provide in the registration Forms and, in particular, although noT exclusively, for damages of any nature that could be due TO third party user impersonation in any type of communication that takes place through the site.

8. NO LICENSE

BUMERAN does not grant any license or authorization to use of any kind on its intellectual and industrial property rights or on any other property or right related to the Site, Services or Contents.

9. DENIAL AND TERMINATION OF ACCESS TO SITE AND/OR SERVICES

BUMERAN reserves the right to deny or terminate your access to Site and/or Services, at any moment and without prior warning, if BUMERAN determines that you are in breach of any of these General Conditions or Particular Conditions that shall apply.

BUMERAN reserves the right to decide which companies will post jobs openings on the Site. Likewise, BUMERAN reserves the power to suspend, interrupt or exclude such job openings, at its discretion, at any moment and without prior warning, if it considers that they violate Users’ rights or interests and/or go against the law, morals, generally accepted good manners and public order.

10. PROCEDURE IN CASE OF ACTIVITIES IN VIOLATION OF APPLICABLE LAW

If any User or third party considers that there are facts or circumstances that show the use of contents and/or the carrying out of any activity on the web pages included or accessible through the Site, in violation of applicable law, and, in particular, the violation of intellectual or industrial property rights (patents, industrial models and drawings, brands and trade names, etc.) or other rights, he should notify BUMERAN and include the following things in the notification: (a) claimant personal information: name, address, telephone number and e-mail address; (b) specific information about the supposed illicit activity taking place on the Site and, in particular, when it is about a supposed violation of rights, precise and concrete indication of protected contents and its location on the web pages; (c) facts or circumstances that reveal the illicit nature of such activity; (d) supposing there is violation of rights, authentic signature or equivalent, including personal information about the holder of the supposedly violated rights or that person authorized to act on his behalf; (e) specific, clear declaration under claimant responsibility that the information provided in the notification is accurate and of the illicit nature of the use of contents and the carrying out of the described activities.

11. DURATION AND TERMINATION

In principle, the provision of Site Services and other Services is for an indefinite period. However, BUMERAN is authorized to suspend or terminate the provision of Site Services and/or any of the other Services at any moment, without detriment of what was stipulated on the matter in the corresponding Particular Conditions. If reasonably possible, BUMERAN will warn Users of the suspension or termination of the provision of Site Services and the other Services.

12. APPLICABLE LAW AND JURISDICTION

These General Conditions are controlled by Argentine republic laws.

BUMERAN and the User, renouncing any other jurisdiction, submit to the jurisdiction of those Courts corresponding to the address of the User for any controversy that could arise from the provision of services that are the object of these General Conditions. If the User’s address is located outside the Argentine Republic , BUMERAN and the User submit, renouncing any other jurisdiction, to the Courts of the City of Buenos Aires ( Argentine Republic ).
